These Terms of Service ("Terms") form a legally binding agreement between you and the Charmly Team governing your access to and use of the Charmly mobile application, websites (if applicable), and related services (collectively, the "Service").

Charmly may remove or restrict User Content that violates these Terms or poses a risk to users or the platform.
9. Communication Between Users
Charmly allows users to communicate through private messaging and other interactive features.
You are solely responsible for the content you send and your interactions with other users.
While we strive to foster a respectful community, Charmly does not endorse, verify, or guarantee the identity, intentions, or accuracy of information provided by users.
When communicating with others, you should exercise reasonable judgment and avoid sharing sensitive personal or financial information.
Any decisions to continue conversations or meet another user outside the Service are made entirely at your own discretion and risk.
10. Community Standards
To help create a safe and welcoming environment, all users are expected to treat others with respect.
The following behaviors are prohibited, including but not limited to:
Harassing, threatening, or intimidating other users;
Promoting violence or illegal activities;
Hate speech or discriminatory content;
Fraudulent or deceptive conduct;

13. In-App Purchases
Certain digital features and services are available through in-app purchases.
All purchases are processed through the applicable application marketplace, including Google Play Billing where required.
Unless otherwise required by applicable law:
Purchases are considered final;
Digital purchases are licensed for personal use only;
Digital purchases cannot be exchanged for cash or transferred to another account;
Refund requests are governed by the refund policies of the applicable app marketplace.
Users are responsible for reviewing applicable purchase terms before completing any transaction.
14. Premium Content
Some areas of the Service may include optional premium content or premium experiences that are available only after completing the applicable purchase or subscription.
Access to premium content is provided solely for your personal, non-commercial use.

Unauthorized access to premium features or content may result in immediate termination of your account.

Except for User Content submitted by users, all rights, title, and interest in the Service, including but not limited to:

Graphics;
Logos;
Trademarks;

Icons;
Databases;
Features and functionality,
are owned by or licensed to the Charmly Team and are protected under applicable intellectual property laws.
Nothing in these Terms grants you ownership of any intellectual property rights belonging to the Charmly Team.
16. Content Review and Moderation
To maintain a safe platform, Charmly may review or investigate content or account activity where reasonably necessary.
Moderation activities may include:
Reviewing user reports;
Detecting spam or fraudulent behavior;
Identifying suspected policy violations;
Responding to legal requests;
Protecting users and maintaining platform integrity.

17. Availability of the Service

Enforcement actions may be taken if we reasonably determine that a user has:
Violated these Terms or our community standards;
Submitted false, misleading, or fraudulent information;
Engaged in abusive, deceptive, or unlawful conduct;
Attempted to compromise the security or operation of the Service;
Repeatedly violated our policies after receiving warnings;
Created multiple accounts to evade enforcement actions.
For serious violations, including those involving child safety, fraud, or illegal activities, we may immediately terminate an account without prior notice.
Following account termination:
Access to the Service will end immediately;
Premium benefits may no longer be available;
Certain information may be retained where required by applicable law or necessary to protect our legitimate interests.
19. Disclaimer of Warranties
The Service is provided on an "AS IS" and "AS AVAILABLE" basis.
To the fullest extent permitted by applicable law, the Charmly Team disclaims all warranties, whether express, implied, statutory, or otherwise, including warranties of:
Merchantability;
Fitness for a particular purpose;

Reliability.
We do not guarantee that:
The Service will always operate without interruption;
The Service will be free from errors or technical issues;
Any defects will be corrected immediately;
Communications or interactions between users will meet your expectations;
Any relationship, friendship, or other connection will result from using the Service.
Your use of the Service is entirely at your own risk.
20. Limitation of Liability
To the maximum extent permitted by law, the Charmly Team, its affiliates, licensors, employees, contractors, and service providers shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to:
Your access to or use of the Service;
User-generated content;
Communications or interactions with other users;
Unauthorized access to your account;
Temporary interruptions or unavailability of the Service;
Loss of data, profits, revenue, business opportunities, or goodwill.
Where liability cannot be excluded under applicable law, our total liability for any claim relating to the Service shall not exceed the greater of:
The total amount you paid to Charmly during the twelve (12) months immediately preceding the event giving rise to the claim; or
USD $100.00
Some jurisdictions do not permit certain limitations of liability. In those jurisdictions, the above limitations shall apply only to the extent permitted by applicable law.
21. Indemnification
You agree to indemnify, defend, and hold harmless the Charmly Team, its affiliates, officers, employees, licensors, contractors, and service providers from and against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of or related to:
Your use of the Service;
Your User Content;
Your violation of these Terms;
Your violation of applicable laws or regulations;
Your infringement of the rights of another person or entity.
This obligation survives the termination of your account and your use of the Service.
22. Changes to These Terms
We may revise these Terms from time to time to reflect changes in our services, legal obligations, or operational practices.
When material changes are made, we will update the Effective Date shown at the beginning of these Terms.
Where required by applicable law, we may provide additional notice through the Service or by other appropriate means.
Your continued use of the Service after revised Terms become effective constitutes your acceptance of the updated Terms.
If you do not agree with the revised Terms, you should discontinue using the Service and close your account.
23. Governing Law
These Terms shall be governed by and interpreted in accordance with the laws applicable in the jurisdiction in which the Service is operated, without regard to conflict of law principles.
Nothing in these Terms limits any mandatory consumer rights that may apply under the laws of your country or region of residence.
24. Severability

The invalidity of one provision shall not affect the validity of the remaining provisions.

Any waiver must be expressly made in writing by the Charmly Team.
26. Entire Agreement
These Terms, together with our Privacy Policy and any additional policies or guidelines expressly incorporated by reference, constitute the entire agreement between you and the Charmly Team regarding your use of the Service.
They supersede all prior or contemporaneous agreements, communications, or understandings relating to the Service.
